FIRE PROTECT MONACO SURL operates the website www.mondialsignaletique.fr under the trade name Mondial Signalétique.
Any individual or legal entity wishing to purchase a product or service on the website www.mondialsignaletique.fr is hereinafter referred to as the Client.
By placing an order, you acknowledge that you have read and unreservedly accept these General Terms and Conditions of Sale.
Confirmation of an order constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.
Object
The purpose of these General Terms and Conditions of Sale is to set out the terms and conditions applicable to sales made on the website www.mondialsignaletique.fr, as well as the respective rights and obligations of Mondial Signalétique and its Clients.
These include, in particular, the sale of road signs, safety signs, fire safety signage, evacuation signs, accessibility signage, prohibition signs, mandatory signs, warning signs, information signs, labels, customised signage products, bespoke printing, evacuation plans, emergency response plans and, more generally, any product offered on the website.
Our products available online and pricing information
Each product featured on the website is accompanied by a description designed to inform the Customer of its main features.
Mondial Signalétique endeavours to present its products as accurately as possible.
Photographs, illustrations, previews, visuals, computer simulations and product renderings are shown for information purposes only.
Slight differences in colour, finish, texture or appearance may occur, depending on the substrate used, the printing technique, the settings of the Customer’s screen, the material chosen or technical constraints relating to the manufacturing process.
These differences cannot be regarded as a fault provided that they do not affect the essential characteristics of the product ordered.
The prices shown on the website are in euros.
Delivery charges are not necessarily included in the product’s displayed price. Where applicable, they are added before the order is finally confirmed.
Mondial Signalétique may change its prices at any time.
The applicable price remains that displayed at the time the Customer confirms the order.
Personalised products
Mondial Signalétique enables customers to order personalised products.
Customisation may include, amongst other things, the text, dimensions, material, colours, pictograms, logos, images, layout, shapes and various graphic elements.
The Customer is responsible for the information and files they provide to Mondial Signalétique.
In particular, it is their responsibility to check the spelling, contact details, dimensions, text, references, requested colours, logos, pictograms and the positioning of the various elements.
Any personalised product, whether created or configured by the Customer, is manufactured specifically to their requirements.
Personalised products cannot be returned, exchanged or refunded, except where they arrive damaged, incorrectly printed, have a manufacturing fault, arrive in a condition that prevents their normal use, or do not comply with the approved proof, where the error is attributable to Mondial Signalétique.
Any error in the text, dimensions, colour, logo, pictogram or layout contained in the proof approved by the Customer shall not give rise to a refund, exchange or remanufacture if the manufactured product corresponds to the approved proof.
Mondial Studio
Mondial Signalétique offers an online customisation tool that enables customers to design certain products directly.
In particular, the Customer can use Mondial Studio to customise their panel by selecting or adding various elements.
The preview generated by the tool allows the Client to view their project before approval.
The Customer is responsible for the content they create and approve.
An error in a design produced directly by the Client shall not be regarded as a manufacturing error on the part of Mondial Signalétique where the manufactured product corresponds to the approved file or proof.
Ready for printing, BAT
When a proof, hereinafter referred to as ‘BAT’, is presented to the Client prior to production, the Client must check it carefully.
Approval of the proof binds the Client to all the elements contained therein.
In particular, it is the Customer’s responsibility to check the text, spelling, dimensions, colours, pictograms, logos, quantities, overall layout and any regulatory information.
Once the proof has been approved and production has commenced, no changes can be guaranteed.
If the product delivered corresponds to the approved proof, any error originally present on the proof cannot be regarded as a manufacturing error attributable to Mondial Signalétique.
Files, logos and other materials provided by the Client
The Client warrants that it holds the necessary rights to use and reproduce all the material it provides to Mondial Signalétique.
This applies in particular to logos, trade marks, photographs, drawings, illustrations, texts, pictograms and graphic designs.
The Client shall indemnify Mondial Signalétique against any claim by a third party relating to the use of any item supplied by the Client.
Mondial Signalétique reserves the right to refuse to manufacture a product where the content appears to be manifestly unlawful or incompatible with its business.
Evacuation plans and emergency response plans
Mondial Signalétique offers a tool that allows you to create evacuation plans and emergency response plans directly online.
The Customer enters and positions the various elements required to design their plan themselves.
He remains responsible for the accuracy of the information provided, in particular regarding the layout of the premises, circulation routes, staircases, exits, emergency exits, fire safety equipment, fire extinguishers, fire hose reels, alarms, power cuts, assembly points, pictograms and building-specific instructions.
The Customer must check their plan before final approval.
The tool provided by Mondial Signalétique is intended to assist with the preparation of the document and does not exempt the person responsible for the premises from checking the regulatory requirements applicable to their building.
Placing an order
To place an order on www.mondialsignaletique.fr, the Customer must select the desired product(s), choose the available specifications, make any customisations, check the proof where one is provided, add the products to the basket, provide the necessary billing and delivery details, check the contents of the order, select the delivery method, select the payment method, accept these General Terms and Conditions of Sale, and confirm the order.
Final confirmation of the order constitutes acceptance of these General Terms and Conditions of Sale.
An order confirmation is then sent to the Customer by email.
Payment
Mondial Signalétique offers a range of payment methods, including credit/debit cards, bank transfers, cheques and administrative payment orders.
The order can only be put into production once payment has been received or confirmed, where the chosen payment method requires this.
For payments made by credit card, Mondial Signalétique uses the Caisse d’Épargne’s secure SystemPay system.
Bank details are processed by the secure payment service provider.
Mondial Signalétique does not store the full number of the bank card used by the Customer.
Delivery information and charges
Delivery charges are calculated based on, amongst other things, the destination, weight, dimensions, volume of the order and the method of transport.
These are communicated to the Customer before the order is finally confirmed.
Mondial Signalétique offers delivery within France and internationally, subject to the destinations listed on the website.
The delivery times shown are approximate.
In particular, these may vary depending on product availability, the quantity ordered, production lead times, customisation, the destination, the carrier, peak periods and force majeure.
Products requiring specialised or bespoke manufacturing may take a little longer to produce.
Receipt of goods
Upon delivery, the Customer must check the general condition of the parcel and the goods.
If there is visible damage, he must make a claim to the carrier that is as specific as possible.
A general statement such as ‘subject to unpacking’ does not necessarily allow for a precise description of the damage.
The Customer is advised to take photographs of the parcel before opening it if any external damage is observed.
Damage in transit
In the event of damage, particularly where a product is damaged inside a parcel, any claim against Mondial Signalétique must be made within 48 hours of delivery.
In order for the claim to be processed, the Customer must provide a clear photograph of the consignment note, one or more photographs of the damaged goods and, if necessary, photographs of the parcel and its packaging.
The supporting documents required for the processing of the case must be provided within a maximum of 14 days from the date the dispute is reported.
If the necessary documents are not received within this timeframe, Mondial Signalétique may close the case due to insufficient supporting documentation.
Item missing or item different from the order
The Customer has 1 day from the date of delivery to report that a product is missing from their order or that they have received a product different from the one ordered.
The complaint must be made by email to [email protected].
The Customer must provide their order number and submit the supporting documents required to process their request.
Manufacturing fault or printing error
Where a product has a manufacturing fault, a printing error, a visible defect or a discrepancy from the approved proof that is attributable to Mondial Signalétique, the Customer must contact customer services as soon as the problem is noticed.
The Customer must provide their order number, the relevant product reference, one or more photographs of the product and a detailed description of the fault found.
Mondial Signalétique will check that the product complies with the order and the approved proof.
Where the fault is confirmed and attributable to Mondial Signalétique, the product may, as appropriate, be replaced, remanufactured, exchanged, credited or refunded.
In the case of a bespoke product, no refund may be claimed for an error arising directly from the information or the proof approved by the Customer.
Delivery problem caused by the customer
In the event of a failed delivery due, in particular, to the recipient’s absence, an incorrect address, an incomplete address, an error in the information provided by the Customer, or the inability to access the delivery location, additional costs for a second delivery attempt, return and redispatch may be charged to the Customer.
A new consignment may be subject to these charges being paid in advance.
Right of withdrawal
Where the right of withdrawal applies to the order and to the Customer in question, the Customer has a period of 14 days from the day after delivery of their order.
The Customer must inform Mondial Signalétique of their intention to withdraw within this period.
They then have a maximum of 14 days from the date their notice of withdrawal is sent to return the products in question.
The Customer is responsible for the direct costs of returning the goods.
Products must be returned complete, unused, undamaged and in a condition suitable for resale.
The right of withdrawal provided for in this article applies to standard products that can be put back on sale.
Personalised products and the right to cancel
Personalised products, which are manufactured or printed specifically in accordance with the Customer’s instructions, cannot be returned, exchanged or refunded simply because the Customer has changed their mind.
In particular, the following are considered to be personalised: signs bearing text chosen by the Customer; signs bearing a logo or image supplied by the Customer; products manufactured to specific dimensions; graphic designs produced on request; products printed on request in accordance with a personalisation specification, evacuation and emergency response plans produced specifically for the Customer; and any product manufactured on the basis of a personalised proof approved by the Customer.
However, a customised product may be eligible for a refund if it arrives damaged, is incorrectly printed, has a manufacturing fault, arrives in an abnormal or unusable condition, or does not match the approved proof due to an error attributable to Mondial Signalétique.
In this case, Mondial Signalétique will investigate the claim and may, depending on the circumstances, produce a replacement, exchange the item, issue a credit note or provide a refund.
No refund or remanufacture may be claimed where the product corresponds exactly to the approved proof and the error is attributable to the Customer.
Returns and refunds for standard products
Where a return is accepted under the right of withdrawal, the Customer shall arrange for the return at their own expense.
The refund will be processed within a maximum of 14 days.
Depending on the circumstances, Mondial Signalétique may offer an exchange, a refund or a credit note.
Returned goods must be complete and in a condition that allows them to be resold.
Guarantees
The commercial warranty period for products sold on the website is set at one year, unless a product description expressly states a longer warranty period.
In particular, the commercial warranty does not cover damage resulting from misuse, incorrect installation, deliberate damage, poor maintenance, modification of the product, use for purposes other than those for which it is intended, or conditions of use that are incompatible with the selected material.
This commercial warranty does not deprive the Customer of any mandatory statutory warranties to which they may be entitled.
Faulty product
If a Customer believes a product to be faulty, they must contact Mondial Signalétique before returning it.
The Customer must provide details enabling the order, the product and the defect found to be identified.
Photographs or other supporting documents may be requested.
If a physical inspection of the product is required, Mondial Signalétique will inform the Customer of the return procedure.
If the fault is recognised as falling within the scope of Mondial Signalétique’s liability or an applicable warranty, Mondial Signalétique may, amongst other things, repair the product, exchange it, reship a compliant product, manufacture a replacement, issue a refund or provide a credit note.
Late payment penalties
For business customers on deferred payment terms, any delay in payment may result in penalties being applied.
The amount due will be increased by 10 points per year in the event of late payment.
A fixed-sum charge of €40 for recovery costs may also be applied where the legal conditions for doing so are met.
Intellectual property
All the elements present on www.mondialsignaletique.fr may be protected by intellectual property law.
This applies in particular to the name ‘Mondial Signalétique’, logos, text, photographs, illustrations, pictograms, designs, graphic designs, interfaces, the website layout, customisation tools, ‘Mondial Studio’ and the tools for creating plans.
Any unauthorised reproduction, use or distribution of any material belonging to Mondial Signalétique is prohibited, subject to any rights held by third parties.
Data Protection
Mondial Signalétique collects certain personal data necessary, in particular, for creating an account, processing orders, invoicing, payment, delivery, after-sales service and customer relationship management.
Personal data is used for the purposes of operating the website, processing orders and managing the commercial relationship with the Customer.
The Customer may request access to, rectification of, or, where permitted by the applicable regulations, erasure of their personal data.
Any enquiries may be addressed to [email protected] or by post to FIRE PROTECT MONACO SURL, 7 avenue Saint Roman, 98000 Monaco.
Liability
Mondial Signalétique undertakes to manufacture the products in accordance with the specifications set out in the order and, where applicable, the proof approved by the Customer.
The Customer remains responsible for the choice of product, material, dimensions, text, pictograms, placement and the intended use of the product.
It is the Customer’s responsibility to ensure that the signage ordered complies with the regulatory requirements applicable to their premises, building or business.
The advice, simulators, design tools and information provided on the website are intended to assist the Customer but do not replace the need to verify the regulatory obligations applicable to their situation.
Force majeure
Mondial Signalétique shall not be held liable for any delay or failure to perform arising from an event beyond its reasonable control.
This may, in particular, relate to major disruptions affecting transport, supply chains, IT networks, telecommunications, energy, suppliers or means of production.
Amendments to the General Terms and Conditions of Sale
Mondial Signalétique reserves the right to amend these General Terms and Conditions of Sale at any time.
The General Terms and Conditions of Sale applicable to an order are those accepted by the Customer when confirming that order.
